Child support payments<\/strong>
\nOne of the main bones of contention in a divorce is the matter of child support payments.<\/p>\n

Jewish couples are subject to personal law, which traces its origins to Jewish law. According to the law, the man must support his children until they reach the age of 18.<\/p>\n

Such child support payments are divided into essential child support necessary for sustaining the child, and support payments under \u2018Din Tzedaka\u2019<\/p>\n

Essential child support<\/strong>
\nWhen talking about essential child support, we refer to a child\u2019s basic needs including clothing, food, education, money \u05db\u05dc\u05db\u05dc\u05d4, medical needs, housing payments, and mother\u2019s child care compensation.<\/p>\n

These are the needs the father must supply and they are not determined according to his financial ability or situation (disabled, unemployed and so forth). He must pay for them in full, without subtracting from the set amount. The reason for this is that support payment is meant to cover the child\u2019s most basic needs.<\/p>\n

Nowadays, all family courts regularly decide on awarding essential child support payments for each minor, without the need for special proof, in an amount ranging between approximately NIS 1,250 and NIS 1,350 per month. This amount does not include housing payment, kindergarten, education, and exceptional expenses and\/or expenses under \u2018Din Tzedaka\u2019<\/p>\n

This \u2018minimum amount\u2019 has stood the test of dozens of cases each day in Israeli family courts and serves as a tool and yardstick for setting child support payments for minors.<\/p>\n

Child support under Din Tzedaka<\/strong>
\nChild support payments under Din Tzedaka are given for needs not classified as \u2018essential\u2019 and are divided equally between the father and mother.<\/p>\n

It is important to understand that the mother\u2019s participation in child support under Din Tzedaka applies to children aged 15 and up. Even then, her financial wealth is checked firstly; and only if she succeeds in providing for her own needs and meets the definition of financial wealth, does she participate in such child support.<\/p>\n
