Common law couples are those who have jointly maintained a family framework but are not married to each other. This makes the legal aspects relating to them complex.
The most conspicuous difference between the situations of common law and married couples is the burden of proof. While married couples need only a marriage certificate to prove their legal connection, proving the status of common law couples requires the bringing in of witnesses who know the couple as well as evidence of the couple living together and jointly managing the household.
Naturally, recognizing a couple as being common law implies the possibility of benefiting from the rights of married couples, such as alimony and sharing of property.
